Terms of Service

1. Agreement to Terms

By accessing or using OptiLeads ("we," "us," "our") at optileads.dev, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. We reserve the right to update these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms.

2. Description of Service

OptiLeads provides two services:

• Lead Credits Platform (optileads.dev/dashboard): A credit-based system allowing users to browse and purchase verified business leads for outreach purposes.
• Daily SMS Leads (optileads.dev/home): A subscription service that delivers curated business leads to your phone via SMS every morning at your chosen time.

Leads provided are sourced from publicly available business directories and are intended for legitimate B2B outreach only.

3. Eligibility

You must be at least 18 years old and a resident of the United States or Canada to use OptiLeads. By using the service you represent that you meet these requirements and that you are using the leads solely for lawful business purposes.

4. SMS Messaging Terms

By providing your phone number and subscribing to our Daily SMS Leads service, you expressly consent to receive recurring automated text messages from OptiLeads at the phone number you provide. These messages include:

• A one-time welcome message upon subscribing
• Daily lead notification messages at your chosen delivery time
• Occasional service-related messages about your account

Message frequency: Up to 1 message per day. Message and data rates may apply.

To opt out: Reply STOP to any SMS message at any time. You will receive one final confirmation message and no further messages will be sent. You can also cancel your subscription at any time from your dashboard at optileads.dev/dashboard/subscriptions.

Consent to receive SMS messages is not a condition of purchase. Opting out of SMS does not cancel your subscription — you must cancel separately through the dashboard or billing portal.

5. Subscriptions and Billing

Paid subscriptions are billed on a recurring monthly basis. By subscribing you authorize us to charge your payment method on file each billing period until you cancel. Subscription fees are non-refundable except where required by law.

Free trials: Where offered, free trials automatically convert to paid subscriptions at the end of the trial period unless canceled beforehand. You will not be charged during the trial period.

Cancellation: You may cancel at any time through your dashboard at optileads.dev/dashboard/subscriptions or through the Stripe billing portal. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for partial months.

Credits: Purchased credits do not expire and are non-refundable once purchased. Credits are tied to your account and are not transferable.

6. Acceptable Use

You agree to use leads obtained through OptiLeads only for lawful B2B outreach. You must not:

• Use leads for spam, harassment, or unsolicited bulk messaging
• Resell or redistribute leads to third parties
• Use leads to contact individuals on any Do Not Call registry in violation of applicable law
• Use leads for any purpose that violates the CAN-SPAM Act, TCPA, or any other applicable law
• Scrape, copy, or reproduce the OptiLeads platform or its data
• Attempt to gain unauthorized access to any part of the service

We reserve the right to terminate your account immediately and without refund if you violate these acceptable use terms.

7. Lead Accuracy

Leads are sourced from publicly available business directories and are verified at time of collection. We make no guarantee that lead contact information is current, accurate, or will result in a successful business connection. We are not responsible for any outcomes resulting from your outreach to leads provided through the service.

8. Intellectual Property

All content, design, code, and data on optileads.dev is owned by OptiLeads and protected by applicable intellectual property law. You may not copy, reproduce, or create derivative works from any part of the platform without our written permission.

9. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or that leads will meet your specific business needs.

10. Limitation of Liability

To the fullest extent permitted by law, OptiLeads shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.

11. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
